Biofuels reforms & FuelCheck online price board

Case study icon

Service stations are being asked to provide various information to NSW Fair Trading as a result of the
Biofuels (Return by Operators of Service Stations) Notice 2016 and the Fair Trading (FuelCheck) Order Notice 2016. Both of these instruments were published in the NSW Gazette on 6 May 2016.

The information will assist the NSW Government to deliver reforms that will improve the regulation of biofuels mandate and encourage greater competition in the retail fuel market. This reform package was announced by the Minister for Innovation and Better Regulation in December 2015 and more information is available in the Minister's media release.

Service station operators can provide their information by using an online form or by filling out a spreadsheet. Operators with multiple premises may find it easier to use the spreadsheet. Both formats are provided on the NSW Fair Trading website.

Service stations operators are legally required to provide their information. They should provide accurate and complete data to the best of their ability. Failure to provide a complete and accurate return may be treated as an offence and heavy penalties apply. Fines of over $5,500 may be imposed on individuals and corporations.

Service station operators are required to provide their response by 30 June 2016.

To help service stations better understand the requirements the NSW Fair Trading website has a list of ‘frequently asked questions’.  If operators have any questions regarding these requirements they can call Fair Trading on 13 32 20 or email fuelsurveyresponses@finance.nsw.gov.au.
